COURT THROWS BULIISA SERVICE COMMISSION BOSS OUT OF OFFICE

MASINDI: Jessy Byaruhanga the resident judge Masindi High Court has Thursday afternoon thrown Dinah Kasangaki the Buliisa district service commission chairperson out of the office.

This follows the case filed at Masindi High Court in May 2021 by Gilbert Tibasiima the district councilor representing Kigwera sub county challenging the appointment of Dinah Kasangaki as the Buliisa district service commission chairperson.

Kasangaki was appointed by Agaba Kinene Simon the former Buliisa district chairperson in March 2021 and was serving her second term in the office. Agaba lost the general elections to Fred Lukumu in January 2021.

Following her {Dinah} appointment, Tibasiima ran to Masindi High Court in May 2021 challenging her appointment since she wasn’t the ordinary resident of Buliisa as law requires.

In his ruling, Jessy Byaruhanga the Resident Judge Masindi High Court ruled an order of mandamus directing the Buliisa district council/ local government to appoint a person competent and qualified as provided in the Local Government Act to exercise the powers and duties of the office of the Buliisa district Chairperson Buliisa District Service Commission.

The judgment further stated that no order as to damages as no evidence was led by the application to justify any and no order as to costs because 1st Respondent was holding a public office in the 2nd Respondent Local Government.

Speaking to our reporter at Masindi High Court after the ruling, Gilbert Tibasiima the district councilor representing Kigwera Sub County said that they have for several times challenged the appointment of Dinah Kasangaki at the district level and the local government but wasn’t honored.

He explained that they decided to ran to Masindi High Court since Agaba Kinene Simon the former Buliisa district Chairperson illegally nominated and cause the appointment of Dinah Kasangaki to the position of the Chairperson District Service Commissioner.

Tibasiima further asserted that the declaration for issuance of appointment letter and swearing in of Kasangaki as the district service commissioner by the chief administrative officer was illegal as it emanated from an illegal appointment.

‘’The declaration decision to appoint Kasangaki did not follow proper procedure and hence is ultra, vires, void and illegal, we are happy that the judgment has been made,’’ Tibasiima noted.

Tibasiima who also doubles as the vice chairperson Buliisa district asserts that they have spent over 15million Uganda shillings on this case.

Efforts to get a comment from Dinah Kasangaki were futile by press time since she didn’t appear at Masindi High Court and her known number wasn’t available.
