I WILL NOT GO TO PRISON – MABIRIZI

KAMPALA: On Tuesday, Justice Musa Ssekaana sentenced the controversial City Lawyer Male Hassan Mabirizi to 18 months imprisonment for contempt of court.

This followed a protracted battle Mabirizi has been embroiled in with the judge. This also follows Mabirizi’s failure to pay Shs300m fine to Ssekaana.

Last week, Ssekaana summoned Mabirizi to appear in court to show cause why he should not be committed to civil prison over contempt of court.

However, the controversial lawyer did not appear before court but instead hired lawyer Noel Nuwe of Ojok and Company Advocates to represent him.

Mabirizi has been representing himself in all cases but he had instructed Nuwe to represent him to avoid being arrested in the courtroom on orders of the presiding Judge Musa Ssekaana.

”Justice Madrama of Court of Appeal will hear my Application to stay execution of all Ssekaana’s orders under Misc. Application No. 843 of 2021, including his illegal order that I be detained for 18 Months,” Mabirizi asserts.

The controversial city lawyer told ugreports that Justice Ssekaana has ignored a recusal Application filed on 11 Feb 2022 by not making a decision on it, which is unconstitutional.

”Having been served yesterday in the evening with a letter Application filed on the 14 Feb after Ssekaana’s illegall notice to show case, yet I was to appear in East African Court of Justice on Tuesday, my lawyer asked for time to reply which Ssekaana, again illegally rejected,” he said.

Mabirizi says Ssekaana has refused to hear two Applications for stay of execution which are pending before him.

“The order is illegal because no man can be a judge in his own cause. All in all, Ssekaana breached every fair hearing principle and I hence reject his unconstitutional ruling. I am hopeful that Court of Appeal will stay the implementation of all these illegalities come Monday. I will at no time be bowed down by illegal orders,” Mabirizi said.
